ADDING A NEW LEGAL HOLIDAY TO EMPLOYEE BENEFITS
WHEREAS, Boundary County has reviewed its employee policy pursuant to the authority conferred by Article XII, Section 2, of the Constitution of the State of Idaho and Title 31, Chapter 8, Idaho Code, and
WHEREAS, Boundary County is a political subdivision of the State of Idaho, operating under the provision and the laws of the State of Idaho, and as such is authorized and empowered to make decisions regarding its employees’ benefits, and
WHEREAS, On June 17, 2021, The President of the United States of America, Joseph R. Biden Jr., signed the Juneteenth National Independence Day Act proclaiming June 19 a federal holiday, and
NOW, THEREFORE, be it resolved by the Board of Boundary County Commissioners that it is in the best interest of the County to amend the Boundary County Personnel Policy Rule 6F Employee Benefits, Legal Holidays to read as follows:
RULE 6: EMPLOYEE BENEFITS
F. Legal Holidays:
1. Eleven official holidays are provided for full-time employees. Full-time employees receive compensation for that day even though they do not work. Part-time employees do not receive holiday pay unless they work the holiday. To compensate all county employees equally, Boundary County recognizes a holiday as eight (8) hours.
Holidays which fall on Saturday will be observed on the preceding Friday. Those which fall on Sunday will be observed on the succeeding Monday. The holiday schedule may be changed at any time by the Board of County Commissioners.
If an employee’s regularly scheduled day off falls on an actual or recognized holiday, the employee will be scheduled to receive a substitute holiday. Substitute holidays must be used within thirty (30) days of being accrued or they will be compensated for.
Any full-time or part-time employee who is scheduled to work on a holiday will be compensated at a rate of one and one-half (1 ½) times the employee’s regular rate of pay.

THERE WILL BE ONLY ONE (1) HOLIDAY GRANTED PER EMPLOYEE; EITHER THE RECOGNIZED HOLIDAY OR THE CALENDAR HOLIDAY, WHICHEVER APPLIES.
THIS RESOLUTION shall be effective on October 1, 2021.

9:30 a.m., Commissioners contacted County Civil Attorney Tevis Hull via telephone to get an update on various topics.
Those present briefly discussed the National Opioid Settlement Notice. The term of this program is 17 years, according to Attorney Hull.
Chairman Dinning said Boundary County collects $1.25 per telephone line for emergency 911 communications tax and he inquired about the ability to increase that amount, but added that he doesn’t think the county can increase it. Attorney Hull suggested Commissioners contact the legislature.
Attorney Hull said he will contact Road and Bridge Department Co-Superintendent Renee Nelson about the status of the Garvin Williams matter.
Commissioners commented that they received copies of complaints sent out by Planning and Zoning regarding alleged violations. Attorney Hull said in one instance a site visit has been requested to further verify the complaint.
Attorney Hull updated Commissioners on the status of the Riverside Road Improvement Project. The county has to have the landowner right-of-way contracts in place so Ms. Nelson just needs to make sure the contract language is correct before trying to get signatures.

Commissioner Cossairt moved to go into executive session pursuant to Idaho Code 74-206(1)b, to consider the evaluation, dismissal or disciplining of, or to hear complaints or charges brought against, a public officer, employee, staff member or individual agent, or public-school student. Commissioner Bertling second. Commissioners voted as follows: Chairman Dinning “aye”, Commissioner Cossairt “aye” and Commissioner Bertling “aye”. Motion passed unanimously. The executive session ended at 11:25 a.m. No action was taken.
Commissioner Cossairt moved to go into executive session pursuant to Idaho Code 74-206(1)f, to communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. Commissioner Bertling second. Commissioners voted as follows: Chairman Dinning “aye”, Commissioner Cossairt “aye” and Commissioner Bertling “aye”. Motion passed unanimously. 1:30 p.m., Commissioners reconvened for the afternoon session with Chairman Dan Dinning, Commissioner Wally Cossairt, Commissioner Tim Bertling, Clerk Glenda Poston, and Deputy Clerk Michelle Rohrwasser.
1:30 p.m., County resident Tim Tucker joined the meeting to request Commissioners abandon a portion of Avonlea Farm Road from the area where trucks turn around. Mr. Tucker added that it’s approximately 435 feet from his estimate, it’s a dead-end and when people occasionally drive and stop up there and are lost, etc., it’s like they’re in your backyard. Mr. Tucker commented that he raises and trains horses and at times they get loose so it would be nice to be able to close a gate. If he can get the 435 feet abandoned, he can put up a fence. Mr. Tucker said he is asking Commissioners to consider holding a public hearing to consider the abandonment. Commissioner Bertling asked about letters from neighbors advocating for the abandonment. Mr. Tucker said there is only one neighbor; otherwise he owns property on both sides. Northern Lights Inc., was contacted and they have no interest. Chairman Dinning asked if anyone has an easement through this area and Mr. Tucker said no, there are no utility easements across this area to other neighbors. Chairman Dinning suggested giving this some thought, because the county will have to create a turnaround. It was said where Columbia Lane and Avonlea Farm Road come together is probably 100 feet in diameter.
Commissioner Bertling moved to go forward with the request to abandon a portion of Avonlea Farm Road made by Tim Tucker. Commissioner Cossairt second. Motion passed unanimously.
Mr. Tucker left the meeting at 1:34 p.m.

2:00 p.m., Restorium Administrator Karlene Magee joined the meeting. Ms. Magee commented that she is short staffed at the Restorium and still in the process of moving residents into different rooms. The number of residents is at 28, but a new resident is coming tomorrow so there will be 29. Chairman Dinning informed Ms. Magee that he spoke to a relative of someone who is also an administrator at an assisted living facility and this person is also having to work double-shifts, etc., because they can’t find anybody to work. Ms. Magee spoke of looking into possible funding opportunities for the Restorium that is based on the number of residents on Medicaid.
The meeting with Ms. Magee ended at 2:11 p.m.
