At 6:00PM Chairman Caleb Davis identified the presence of a quorum, opened the Workshop, introduced the Commission members and presented the evening workshop agenda.
Davis asked the Commission if there were any changes or corrections to be made to the Minutes of the September 20, 2018 meeting. There being none, Davis asked for a motion to approve the September 20 Minutes. Rob Woywod so moved, seconded by Wade Purdom, and there being no further discussion Davis called for a vote. The votes were as follows:

The motion to approve the September 20 2018 meeting minutes was unanimous.
Staff suggested to Chairman Davis that since there are a number of people present wishing to express their views on something, it would be appropriate to alter the sequence of events on the Agenda (Public Comment), and asked if there were anyone present who would like to make a statement to the Planning and Zoning Commission. In so doing, Davis asked anyone speaking to identify him/her self, saying that although the agenda for the meeting included time for public comment it would be more appropriate to just comment at this point in the workshop rather than encumber the meeting with a timer procedure.
John Poland introduced himself and said he was returning to the Planning and Zoning meeting and said everyone here and several neighbors who were unable to attend were opposed to what he considered to be junk being placed on his neighbor's property. The Planning and Zoning Commission said (again) that the County Ordinance 9B18LOV1 requires screening a junkyard from view.
Poland said the junkyard should not be allowed to establish itself. Period. He added, what good does it do if there is no regulatory action taken? Planning and Zoning Commission discussion agreed there is a problem when someone violates an ordinance and there is no repercussion. Mr. Poland ended his comments by saying what he had said in the last meeting - that he is of the opinion that if there are no controls in place to prevent this type of intrusion it will become public knowledge and Boundary County will become 'the Nations dumping ground' - his opinion, his words.
Wayne Bates said that if he has a salvage yard next door he has no intention of living here. He said there is NO building material being brought in, just junk, and this is NOT a good use for this zone. Also, there was a fresh load of derelict vehicles and huge tires; this location is just a pure dumping ground (for junk).
Staff said that it is not the person bringing the material to the site but the land owner who is responsible. He said that it must be Staff who must communicate with the land owner regarding this complaint.
Grant Thompson asked if there isn't environmental concerns, because of the potential for hazardous materials?
Ron self stated that if there are hazardous material concerns this involves other agencies (e.g., Idaho DEQ).
Roger Cumbo stated that he is concerned because his well is located fifty feet from the location of this junk material. The leakage of hazardous fluids into his water system is a matter of grave concern for him.
John Poland spoke up again and said that, based on ordinance 7.5 Failure to obtain a Conditional Use permit prior to establishing use for which one was required will constitute a misdemeanor pursuant to Section 4.3.4. and he is requesting Staff to pursue Section 4.1.3.4. if it is determined that this is a junkyard - because - the owner is in violation right now! He is requesting that Staff send a notice of violation right away.
Lisa Aguilar and Clark Fairchild observed the proceedings but said nothing. The members of the Planning and Zoning Commission considered the dialogue and suggested that perhaps Staff should send such a letter. Staff announced that normally he works from 9-5 but on this night, after the meeting, he would send a letter to Steven Ballard to make him aware of his responsibilities regarding the use of his land. All agreed that this was a good thing.
Chairman Davis asked Staff for ideas relating to to updating the Comprehensive Plan Map. Staff said that the responsibility for making sweeping changes to local areas of the Map was out of the question. Further, to hold public meetings at various locations in the County, all scheduled in a relatively short period of time, was also out of the question. In response to various questions from the Commission members, Staff said that the Planning and Zoning Commission cannot undertake the responsibility of mandating changes, especially since the Comprehensive Plan, which the Planning and Zoning Commission had adopted recently and with no changes being sought for the Plan, there was nothing pending that suggested a Map change was warranted.
The Planning and Zoning Commission then discussed when and how the Comprehensive Plan Map might be updated. Staff suggested an approach that would meet the needs of the County to maintain the Comprehensive Plan Map;
- Plane for an update every 10 years. This has just been done, and the Map was approved as-is
- Copy the LAND USE Zone Map to become the updated/current Comprehensive Plan Map
- Update the Land Use Zone Map as needed; this will become the new Comp Plan Map at the next 10-year renewal cycle
Staff noted that there have been very few changes made to the Land Use Zone Map, and only one completed thus far subsequent to establishing 9b18LMV1, creating 9B18LMv2 on January 24 2018.
A second change necessitated by an approved map change (Prime Forest zone changes to Agriculture Forestry on September 20 2018) remains to be applied to the Land Use Zone Map 9b!8LMV2, creating 9B18LMV3. However, as discussed within this workshop meeting, other lands are incorrectly zoned in this same manner. Specifically, parcels have been zoned as Prime Forest that should have been zoned Agriculture/Forestry; these must be identified and added to make up the changes destined for the 9B18LMV3 update. Note; Wade Purdom has volunteered to scan the current Zone Map to identify these parcels.
Clark Fairchild asked about the changes he feels are necessary to alter the zone of his land so that he can use his land in ways the current zone does not allow. It was agreed the ordinance allows for this (Section 18.1.3. and 18.2.1.2.) and that an application may be submitted for processing.
There are a few things to iron out (applying for a zone map change versus a comprehensive plan map change), but over-all the approach to updating the Comprehensive Plan Map seamed reasonable and Staff is requested to discus this approach with Tevis Hull, then carry this suggestion to the Boundary County Commissioners as a recommended approach to be followed on the ten-year anniversary date of the Comprehensive Plan and the Comprehensive Plan Map.
Rob Woywod moved to adjourn, Wade Purdom seconded, approved unanimously at 8:35 pm.
